What it actually says

Section 25C gives the Lord Chancellor statutory authority to make regulations regarding children whose cases are referred to officers under section 25B(3).

These regulations can extend the official functions of those officers beyond standard family proceedings (as defined under section 12 of the Criminal Justice and Court Services Act 2000) into other legal proceedings. The regulations can also dictate the specific manner in which officers must perform their duties.

When it applies

  • The Lord Chancellor creates regulations that expand an officer's duties into proceedings outside traditional family court.
  • Regulations dictate the exact operational procedures an officer must follow when handling a case referred under section 25B(3).
  • Secondary legislation specifies how officers exercise functions in non-family court legal contexts for referred children.

What this section does not say

  • The initial appointment or standard functions of Independent Reviewing Officers, which are detailed under section 25A and section 25B.
  • Orders restricting a child's liberty in secure accommodation, which fall under section 25.
  • General care planning duties carried out by local authorities, which are governed by section 31A.

That's the law. Now let's settle your problem.

Say what is happening. A neutral mediator hears your side and the other party's, and walks you both to a written agreement. In the advanced settings you can ask for the decision to be reasoned on the Acts of Parliament that apply in England and Wales.
