What it actually says

Section 79Q of the Children Act formerly set out the statutory framework for inspecting childminders and day care providers in England. This provision has been repealed in full and contains no active statutory text.

Because this section has been repealed, current regulatory inspections of early years child care and day care providers in England no longer take place under this provision. Active inspections are carried out under subsequent childcare legislation.

When it applies

  • Evaluating past regulatory actions taken against an English day care provider under former statutory provisions.
  • Determining whether a historical inspection report was issued pursuant to section 79Q prior to its repeal.
  • Reviewing legacy legislative powers relating to early years childcare inspections in England.

What this section does not say

  • Current Ofsted inspections of childminders and day care facilities in England, which are governed by later childcare legislation.
  • Child care and day care inspections in Wales, which are addressed under section 79T.
