What it actually says
This section defines the special functions of the councils created under Part VII of the Environmental Protection Act 1990. The councils include the Nature Conservancy Council, the Countryside Council for Wales, and the Joint Nature Conservation Committee.
Their special functions cover activities such as establishing nature reserves, giving scientific and conservation advice, and conducting research relevant to nature conservation. These are in addition to their general functions under section 132.
When it applies
- The Countryside Council for Wales uses its special functions to advise the Welsh Government on a proposed wind farm in a sensitive area.
- The Joint Nature Conservation Committee exercises its special functions to provide scientific advice on a marine conservation zone.
- A landowner receives a notice from the Nature Conservancy Council about establishing a nature reserve on his land, and he disputes the council's authority under this section.
What this section does not say
- This section does not cover the general functions of the councils (those are in s.132).
- It does not cover the creation or constitution of the councils (s.128).
- It does not cover grants or loans made by the council (s.134).
- It does not cover the transfer of property from the Nature Conservancy Council (s.135).
