What it actually says

Section 92C of the Environmental Protection Act 1990 originally governed the offence of failing to comply with a litter clearing notice. This section has been repealed from the statute.

Because section 92C is repealed, it contains no enforceable duties, offences, or financial penalties. It cannot serve as the legal basis for formal enforcement action.

Active rules on litter notices, appeals, and enforcement are set out in other provisions of the legislation.

When it applies

  • A local council claiming an offence under section 92C for uncleared waste.
  • A recipient of an enforcement letter checking if section 92C creates an active penalty.
  • A property owner disputing a fine levied under section 92C.

What this section does not say

  • Active requirements for litter clearing notices, which are set out in other sections.
  • Appeals against litter clearing notices, which are governed by separate statutory rules.
  • Fixed penalty notices for littering, which are dealt with elsewhere in the statute.

That's the law. Now let's settle your problem.

Say what is happening. A neutral mediator hears your side and the other party's, and walks you both to a written agreement. In the advanced settings you can ask for the decision to be reasoned on the Acts of Parliament that apply in England and Wales.
