What it actually says
Section 94B gives legal force to Schedule 3A of the Act. This provision enables local authorities to establish rules governing where and how free printed material may be handed out to the public.
Under Schedule 3A, a council can designate specific areas of public land where handing out promotional flyers, leaflets, or free printed matter without prior permission or a permit is restricted.
When it applies
- A local council enforcing permit requirements for leafleting in a designated shopping district
- Promoters handing out event flyers to passersby on a designated public street
- A business owner distributing free promotional printed pamphlets on public land
What this section does not say
- Delivering printed flyers directly through the letterbox of a private home or business
- Distributing leaflets inside private premises, such as within a shopping mall
- Handing out free printed matter for charitable, religious, or political purposes
