MCA 1973 s. 21C defines 'PPF compensation' as compensation payable under the pension compensation provisions, set out in the Pensions Acts 2004 and 2008.
21C In this Part— “ PPF compensation ” means compensation payable under the pension compensation provisions; “ the pension compensation provisions ” means— Chapter 3 of Part 2 of the Pensions Act 2004 (pension protection) and any regulations or order made under it, Chapter 1 of Part 3 of the Pensions Act 2008 (pension compensation on divorce etc ) and any regulations or order made under it, and any provision corresponding to the provisions mentioned in paragraph (a) or (b) in force in Northern Ireland.

What it actually says
Section 21C of the Matrimonial Causes Act 1973 defines two terms used in Part 2 of that Act. 'PPF compensation' means compensation that is payable under what the Act calls 'the pension compensation provisions'.
'Those pension compensation provisions' are set out in the Pensions Act 2004 (Chapter 3 of Part 2) and the Pensions Act 2008 (Chapter 1 of Part 3) and any equivalent Northern Ireland legislation, together with any regulations or orders made under them. In short, this section clarifies which compensation is covered when a court deals with pension compensation in divorce or nullity proceedings.
When it applies
- A divorcing couple where one party receives PPF compensation from the Pension Protection Fund and the court needs to decide if it can be shared.
- A court making a pension compensation sharing order under s. 24E and referencing the definition of PPF compensation.
- A lawyer advising a client on whether a compensation payment from a pension scheme called 'PPF compensation' falls under the pension compensation provisions.
What this section does not say
- How to apply for PPF compensation from the Pension Protection Fund.
- The amount of PPF compensation you can receive.
- The procedure for making a pension compensation sharing order (covered by s. 24E and following).
