What it actually says
This section is now blank and has no legal effect. It originally gave the Welsh Ministers a power to extend the separate collection requirements of section 45A (which applies to England) to Welsh waste collection authorities. That power has been removed, so section 45A does not apply in Wales.
Section 45A itself requires English waste collection authorities to separately collect household waste for recycling. The corresponding duties for Wales are set out in separate Welsh legislation, not in this section.
When it applies
- A Welsh waste collection authority considering whether to implement separate household waste collection under section 45A via this now-spent power.
- A householder in Wales arguing that their waste collection authority must follow the same separate collection rules as English authorities because of this section.
- A dispute between a Welsh council and a regulator over the applicability of the power that this section once granted.
What this section does not say
- This section does not currently give Welsh waste collection authorities any power to apply section 45A to themselves.
- It does not impose any duty on Welsh authorities to separately collect household waste.
- It does not repeal or override any other provisions of the Environmental Protection Act 1990 or Welsh waste regulations.
